Summary

Denmark enforces EU REACH obligations through national chemicals supervision, requiring registration, authorisation compliance, and safe handling of chemical substances. Non-compliance often involves missing registrations, unauthorised uses, or weak documentation and can result in fines, product withdrawal, and market restrictions.

What's Required

Manufacturers, importers, distributors, downstream users and article suppliers may need to:

  • Register chemical substances manufactured or imported at one tonne or more per year.

  • Check whether substances are subject to REACH restrictions.

  • Obtain authorisation before using or placing certain substances of very great concern on the market.

  • Provide safety data sheets where required.

  • Communicate safe-use information through the supply chain.

  • Notify or communicate information on substances of very great concern in articles where applicable.

  • Respond to consumer “right to know” requests about SVHCs in articles.

  • Maintain technical, supplier and compliance documentation.

  • Ensure imported products from outside the EU comply with REACH.

  • Cooperate with inspections by the Danish Chemical Inspection Service.

Important Deadlines

  • June 1, 2007: REACH entered into force at EU level.

  • Registration deadlines have already passed for most phase-in substances, but registration remains mandatory before manufacturing or importing covered substances at one tonne or more per year.

  • Authorisation deadlines apply on a case-by-case basis to substances listed in Annex XIV.

  • Restriction deadlines apply according to the specific entry in Annex XVII.

  • Safety data sheets must follow the applicable EU REACH format and be kept updated when new hazard or risk management information becomes available.

Current Status

Denmark REACH Chemicals Compliance Rules are currently in force.

REACH is directly applicable EU law, while Danish authorities are responsible for supervision, inspection and enforcement at national level. The Danish EPA states that most chemicals legislation within its area is regulated at EU level, including REACH and CLP, and that Denmark’s Chemical Inspection Service monitors compliance with chemicals regulations.

The framework is legally binding and actively enforced. It is not a voluntary chemical management programme.

Denmark also has national priority areas for chemicals enforcement, including areas of particular importance for health and the environment, Danish-specific requirements and imports from third countries.

Penalties for Non-Compliance

  • Statutory fines

Non-compliance may lead to administrative, commercial or legal consequences under Danish chemicals enforcement rules.

Potential consequences may include:

  • Product sales bans or market withdrawal.

  • Orders to correct labelling, documentation or safety data sheets.

  • Restrictions on use or placing on the market.

  • Refusal of market access for non-compliant imported products.

  • Fines or administrative penalties.

  • Enforcement action for breach of REACH restrictions.

  • Penalties for using substances requiring authorisation without approval.

  • Increased inspections or sampling by Danish authorities.

  • Reputational and supply-chain consequences for unsafe or non-compliant chemicals.

Because REACH controls whether chemicals and products may be lawfully placed on the EU market, the most immediate consequence of non-compliance is often market access restriction.

Examples of Known Violations

As of May 2026, we were not able to find a consolidated public database of specific penalties imposed under Denmark REACH Chemicals Compliance Rules against named companies.

However, the Danish Chemical Inspection Service conducts market surveillance and enforcement projects. Danish authorities have previously focused on hazardous chemicals in consumer products, imports from third countries and product categories with health or environmental risks. Enforcement may involve product testing, sales bans, corrective orders, recalls or fines where REACH restrictions are breached.
