What’s Required
Legislative Decree 49/2014 establishes Italy’s national system for Extended Producer Responsibility (EPR) for Waste Electrical and Electronic Equipment (WEEE).
It applies to producers, importers, distributors, retailers and online sellers of electrical and electronic equipment (EEE).
The law requires companies to:
Register in the National Register of EEE Producers.
Join a WEEE Compliance Scheme (Collective System) or set up an individual system.
Finance the take-back, transport, treatment, recovery and environmentally sound disposal of end-of-life EEE.
Provide product marking (crossed-out wheeled bin symbol) and producer identifiers.
Inform consumers about disposal options and collection points.
Report annually the quantities of EEE placed on the Italian market.
Ensure separate collection and proper treatment through authorised centres.
Retailers must provide free 1-for-1 takeback and, for small devices, free 1-for-0 takeback above certain shop sizes.
Important Deadlines
Legislative Decree 49/2014 has been in force since April 2014.
The open scope for all EEE categories applies from 2018 onwards, following EU Directive amendments.
Annual reporting to the national register is due every year (usually in the first quarter).
Producers must update registrations or data whenever changes occur.
Current Status
Legislative Decree 49/2014 remains the core Italian law implementing the EU WEEE Directive.
Italy continuously adjusts collection targets, recycling performance and treatment requirements in line with EU obligations.
Digitalisation of documentation and traceability is being gradually strengthened.
Retail and e-commerce takeback controls have increased, especially for online sellers.
Penalties for Non-Compliance
Penalties include:
Administrative fines for missing registration, incorrect reporting or failing to join an EPR scheme.
High fines for improper management of WEEE, missing labelling, or failure to provide takeback services.
More serious violations (e.g., illegal disposal or improper hazardous component handling) may lead to criminal sanctions.
Authorities may seize products found non-compliant with EPR obligations.
Examples of Known Violations
Enforcement actions have commonly targeted non-registered foreign online sellers, failing to comply with EPR obligations.
Retailers have been fined for refusing free takeback of small WEEE.
Inspections have identified problems with inaccurate annual declarations and unauthorised treatment centres.
Publicised cases frequently involve improper disposal of hazardous WEEE fractions (e.g., refrigerants, screens).
